Convicted IS Fighter from Tajikistan Can Be Finally Expelled from Germany - Germany Lifts Deportation Ban on IS Fighter Despite Torture Fears

In a significant development, a German administrative authority has lifted the deportation ban on a Tajik man who joined the Islamic State militia in 2015 and fought in Syria and Iraq. The decision, made in 2024, reverses an earlier ban imposed due to fears of torture in his home country.

The man, a resident of the Warendorf district, was initially sentenced to five years in prison by the Oberlandesgericht Düsseldorf in 2017 for his involvement in a foreign terrorist organization. In 2018, the Federal Office for Migration and Refugees imposed an expulsion ban, citing concerns about torture or mistreatment in Tajikistan.

The lifting of the ban in 2024 came after assurances from Tajikistan that the man would not face such punishments. The Higher Administrative Court agreed with the Administrative Court's assessment that there was 'no significant probability' of torture or mistreatment, paving the way for the ban's removal. However, the man's appeal against this decision was later rejected by the Administrative Court Münster in August.

The lifting of the deportation ban raises questions about the man's future and the safety of his return to Tajikistan. While the German authorities have acted based on the assurances provided, the situation remains complex and sensitive.
